Interreligious Marriage in Indonesia and Malaysia: Strict and Loose Legal Policy

As a sacred “bond”, a marriage is also a prominent issue before the law. Which, there are judicial and sociological consequences of a marriage resulting in changing someone’s status. In practice, marriages occurred not only between same religion-believers. Interfaith marriages happen when couples of different religions marry without requiring one partner to convert. The objective of this study is to find out the legal issues of interfaith marriages in Indonesia and Malaysia in comparative manner. This study employs normative legal research with comparative and case approach. Data were obtained through literatures or secondary data. The study shows that the Marriage Law of Indonesia does not expressly regulate interreligious marriage, and in the Law on Population Administration, there is no provision mandating that registered marriages must adhere to the same religious beliefs. Interfaith marriages are strictly prohibited by Malaysian Law, and any violations of these laws would lead to the cancellation of marriage legality.
