Studi Perbandingan Regulasi Hukum bagi Pekerja Ekonomi Gig di Sektor Transportasi : Indonesia dan California

This study compares the legal protections for gig workers in Indonesia and California. In Indonesia, the majority of gig workers are classified as partners, which means they do not receive adequate labor protections as stipulated in Government Regulation Number 35 of 2021. In contrast, California implements the ABC5 test, which provides a clearer legal framework for classifying workers as employees or independent contractors. This study employs a comparative legal method to analyze the differences in treatment of gig workers in both regions. The results indicate that the partnership model in Indonesia is detrimental to workers and makes them vulnerable, while the ABC5 test in California provides better protection, despite the challenges in its implementation. Based on these findings, the study recommends that Indonesia immediately develop specific regulations for gig workers. These regulations are expected to provide legal certainty and more adequate labor protection for gig workers as the digital economy grows.
Penelitian ini membandingkan perlindungan hukum bagi pekerja gig di Indonesia dan California. Di Indonesia, mayoritas pekerja gig diklasifikasikan sebagai mitra, sehingga tidak mendapat perlindungan ketenagakerjaan yang memadai seperti diatur dalam PP Nomor 35 Tahun 2021. Sebaliknya, California menerapkan uji ABC5 yang memberikan kerangka hukum lebih jelas untuk mengklasifikasi pekerja sebagai karyawan atau kontraktor independen. Studi ini menggunakan metode hukum perbandingan untuk menganalisis perbedaan perlakuan terhadap pekerja gig di kedua wilayah. Hasilnya menunjukkan bahwa model kemitraan di Indonesia merugikan pekerja dan membuat mereka rentan, sementara uji ABC5 di California memberikan perlindungan lebih baik meskipun ada tantangan implementasi. Berdasarkan temuan ini, penelitian merekomendasikan agar Indonesia segera menyusun regulasi spesifik untuk pekerja gig. Regulasi ini diharapkan dapat memberikan kepastian hukum dan perlindungan yang lebih memadai bagi pekerja gig seiring dengan pertumbuhan ekonomi digital.
